Introduction
Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the Learn It Well platform, website, and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the modified Terms.
Eligibility and Account Registration
Age Requirements
You must be at least 18 years of age to create an account and use our Platform as a student or teacher. For workshops or lessons specifically designed for minors, a parent or legal guardian must register, provide consent, and supervise the minor's use of the Platform.
Account Creation
When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Types
Our Platform offers two types of accounts:
- Student Account: For individuals seeking to book and participate in lessons.
- Teacher Account: For qualified instructors who wish to offer lessons through our Platform.
Platform Services
Lesson Booking and Scheduling
Our Platform facilitates the booking of lessons between students and teachers. Lessons may be conducted online or in-person, depending on teacher availability and preferences.
Payment Processing
All payments are processed securely through Stripe. By making a payment through our Platform, you agree to Stripe's terms of service and privacy policy.
Payment Terms and Refund Policy
Pricing
Lesson prices are set by Learn It Well and are clearly displayed on the Platform before booking. Prices may vary based on lesson type, duration, and package options.
Payment Collection
Payment is required at the time of booking. We accept major credit and debit cards through our secure payment processor.
Lesson Packages
Lesson packages may be offered at discounted rates compared to individual lessons. Package pricing and details will be clearly displayed before purchase.
Cancellation and Refund Policy
Individual Lesson Cancellation
You can cancel individual lessons directly from your account at least 24 hours before the scheduled start time for a full refund. Cancellations made less than 24 hours before the lesson are not eligible for a refund.
Package Cancellation
You can only cancel an entire lesson package (1, 3, or 5 lessons) up to 24 hours before the first scheduled lesson for a full refund. After this time, no refunds are available. Individual lessons within a package cannot be canceled separately for a refund at any time, but they can be rescheduled up to 24 hours before each lesson's start time.
Rescheduling Policy
You can reschedule lessons and change the type (in-person or online) up to 6 hours before any scheduled lesson through your dashboard. After this 6-hour window, rescheduling is not available.
Teacher Cancellation
If a teacher cancels a lesson, you will receive a full refund or the option to reschedule at your convenience.
Satisfaction Guarantee
If you are unsatisfied with a lesson due to teaching quality or technical issues, you may be eligible for a refund. Contact our support team within 48 hours of the lesson, explaining your concerns. We will review your case and may initiate a mediation process with the teacher before issuing a refund.
Teacher Payments
Teachers receive 70% of the lesson fee. Payments are processed on a semi-monthly basis (the 15th and last day of each month) for all successfully completed lessons with confirmed student satisfaction. If a student reports dissatisfaction, payment may be held pending the outcome of our review process.
User Conduct and Responsibilities
General Conduct
You agree to use our Platform in a manner consistent with all applicable laws and regulations and in accordance with these Terms. You agree not to:
- Use the Platform for any illegal purpose or in violation of any local, state, national, or international law
- Harass, abuse, or harm another person
- Impersonate another user or person
- Post or transmit anycontent that is offensive, harmful, or inappropriate
- Interfere with or disrupt the Platform or servers or networks connected to the Platform
- Attempt to gain unauthorized access to any portion of the Platform
Student Responsibilities
As a student, you agree to:
- Attend scheduled lessons on time
- Respect the teacher and follow their guidance
- Use lesson materials only for personal learning purposes
- Provide honest feedback about your learning experience
Teacher Responsibilities
As a teacher, you agree to:
- Provide high-quality instruction as described in your profile
- Be punctual for all scheduled lessons
- Maintain professional conduct at all times
- Provide appropriate learning materials and resources
- Respect student privacy and confidentiality
Intellectual Property Rights
Platform Content
All content on our Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Learn It Well or its content suppliers and is protected by international copyright laws.
Teacher Materials
Teachers retain ownership of their original teaching materials. By uploading or sharing materials on our Platform, teachers grant Learn It Well a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and distribute such materials for the purpose of providing services through our Platform.
Student Usage Rights
AStudents are granted a limited, non-transferable license to access and use the teaching materials provided through the Platform for personal, non-commercial educational purposes only. Students may not:
- Copy, modify, or distribute the materials
- Use the materials for commercial purposes
- Share access to the materials with others
- Provide appropriate learning materials and resources
- Record lessons without explicit permission from the teacher and Learn It Well
Privacy and Data Protection
Privacy Policy
Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal information. By using our Platform, you consent to the collection and use of information as described in our Privacy Policy.
Communication
By creating an account, you agree to receive communications from Learn It Well, including but not limited to lesson reminders, updates, and promotional materials. You can opt out of promotional communications at any time.
Disclaimers and Limitations of Liability
Service Availability
We strive to provide uninterrupted access to our Platform, but we do not guarantee that the Platform will be available at all times. We are not liable for any downtime, service interruptions, or technical issues that may affect access to the Platform.
Errors and Accuracy
While we make every effort to ensure the accuracy of information on our Platform, we do not warrant that the content will be error-free, complete, or up-to-date. We are not responsible for any errors or omissions in content.
Educational Content Disclaimer
The educational content provided through our Platform is for informational and educational purposes only. We do not guarantee specific outcomes or results from using our Platform or participating in lessons.
Professional Advice Disclaimer
Our Platform provides educational services and is not intended to provide professional advice. Content should not be construed as professional advice, and users should consult with qualified professionals before making decisions based on information obtained through our Platform.
Limitation of Liability
To the maximum extent permitted by law, Learn It Well and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Platform
- Any conduct or content of any third party on the Platform
- Any content obtained from the Platform
- Unauthorized access, use, or alteration of your transmissions or content
Indemnification
You agree to defend, indemnify, and hold harmless Learn It Well and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.
Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Dispute Resolution Process
Any dispute arising from or relating to these Terms or your use of the Platform shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation before resorting to arbitration or litigation.
Termination
Termination by You
You may terminate your account at any time by contacting us at liw@learnitwell.org. Upon termination, you will lose access to all services and content associated with your account.
Termination by Us
We reserve the right to suspend or terminate your account and access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason at our sole discretion.
Miscellaneous
Entire Agreement
These Terms constitute the entire agreement between you and Learn It Well regarding your use of the Platform and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void.
